Dmove Software End User License Agreement

This Dmove End User Licence Agreement (the "Agreement") is between you and Dmove ("Dmove"). If you are agreeing to this Agreement not as an individual but on behalf of your company, then "Customer", "Licensee", "your" or "you" means your company, and you are binding your company to this Agreement. Dmove may modify this Agreement from time to time, subject to the terms in section "Changes to this Agreement" below. Terms applicable to specific Dmove Products may be defined in an annexe or appendix to this EULA; such appendices or annexes will incorporate the terms of this EULA and the terms in an appendix or annexe to this EULA will take precedence over the terms set out in this EULA. By clicking on the "I agree" (or similar button) that is presented to you at the time of your Order, or by ordering, using or accessing Dmove Products (as defined below), you indicate your consent to be bound by the terms of this Agreement and the terms of any document referenced herein. If you do not agree to the terms of this Agreement, you may not install, copy, download or otherwise use the software.

1.Scope of the Agreement

This Agreement governs your downloads, initial purchase as well as any future purchases made by you that reference this Agreement. This Agreement includes our Privacy Policy, our DPA, our Terms and Conditions, Product Support Service Level Agreement and any other referenced policies and attachments. This Agreement applies to Dmove Products that you purchase or access from channels which include, without limitation: The Atlassian Marketplace Dmove's own marketplace or website Dmove sales or client services team Atlassian Experts or other partners and resellers who have the capacity to sell Dmove products Other marketplaces, websites, or other mechanisms which sell Dmove products and may refer to this Agreement.

2.Types of Dmove Products

This Agreement governs Dmove's commercially available and in some cases downloadable software products and services ("Software") as well as cloud-based products and services ("Hosted Services"), and any related support or maintenance services provided by Dmove. Software and Hosted Services are referred together as "Products". Please note: elements of Software may be available via Hosted Services and vice versa. In such cases, all relevant terms in this Agreement still govern such elements.

2.1 Software

Software includes products which may be downloaded in their entirety, or have downloadable software components or applications. Software also includes computer software and source code, as well as associated media, icons, images, text files, PDFs or other static non-code assets contained within any form of software, printed materials, and online and electronic documentation and internet-based services. In the Atlassian, Software includes (without limitation) categories of Dmove products (including add-ons) for Atlassian's Data Center (under a subscription licence) applications.

2.2 Hosted Services

Hosted Services includes products and services which are commercially available via a cloud-based platform (or SaaS mechanism). Within the Atlassian, this includes Cloud variants of Dmove products available via Atlassian Cloud platforms. Furthermore, this includes, for example, Dmove's Content & USer management App, available as a SaaS.

3.Consent to Dmove's Policy

These terms set out the terms, conditions, procedures and other necessary matters for the use of business-related services (the “Services”) provided by Dmove (the “Company”). This Privacy Policy and Security Policy applies to all of Dmove's products and is intended to inform you about how we treat customer information provided to us and how we collect, process, use, share, control and protect the information you provide to us.We explain how we collect personal information, why we collect it, how we use and share it, the steps we take to protect this information, and how you can exercise your privacy rights. If you do not agree to this Privacy Policy, please do not use our products and services and do not interact with any other aspect of our business. By submitting information to us in any way, using our systems, products or services (the “Services”), or interacting with us through recruitment, events, sales and/or marketing, you consent to the collection, use and transfer of your information.

4.Information Protection

The Company may change these Terms if there is a reasonable reason, and if the Terms are changed, they shall take effect together with the current Terms by specifying the date of application and the reason for revision.

5.Terms Amendment Procedure

Members may stop using the Service if they do not agree to the changed Terms. We may update this Privacy Policy from time to time. Any revisions to these terms will be effective immediately upon posting and will apply as a condition of your continued participation with Dmove corporation or continued use of our website, software or services. It is your responsibility to check this page periodically for any updates to this Privacy Policy. We encourage you to review our Privacy Policy each time you use our products or services to stay informed about our information practices and how you can help protect your privacy.

6.Compliance with Laws

Matters not specified in these Terms shall be governed by the relevant laws and regulations, if any, and otherwise by the Electronic Transactions Consumer Protection Directive and relevant laws and regulations or general practices enacted by the government. This Privacy Policy explains who we are, how we collect personal information, why we collect it, how we use and share it, the steps we take to protect this information, and how you can exercise your privacy rights.

7.Agreement to Service Use

If you do not agree to this Privacy Policy, please do not use our products and services and do not interact with any other aspect of our business. By submitting information to us in any way, using our systems, products, or services (the “Services”), or interacting with us through recruiting, events, sales, and/or marketing, you consent to the collection, use, and transfer of your information. Dmove will protect your information in accordance with the terms of this Policy.

8.Notification of Changes

We do not store any personal information and if we make any changes to our Privacy Policy, we will notify you of the changes through a notice on our website or other means. We are constantly working to keep our products and data secure for you.
